Owing to the Act 2014-617 of 13th June 2014 called “loi Eckert”, French insurance companies must seek beneficiaries of unclaimed life insurances and term life insurances in order to quickly give them the benefits thereof.
However, Malakoff Médéric did not seem very inclined to achieve this.
On 30th November 2016, M. Médéric requested my civil status certificate due to a term life insurance I am entitled to, following the death of a relative. M.Médéric did not take any action to inform me about this insurance up to then, whereas it had known the death since 2010.
On 14th December 2016, M. Médéric got this certificate by tracking mail.
On 28th December 2016, M. Médéric wrote me back and requested further documents.
On 9th January 2017, M. Médéric duly received them (tracking mail).
In February 2017, I called M. Médéric which argued that it did not get my latest letter. Then, I fruitlessly contacted its complaint department.
In March 2017, I wrote to the Insurance Mediation and asked for:
- the term life insurance I am entitled to,
- penalties for delay. I should have got the insurance within a one month deadline starting from 14th December 2016 (article L132-23-1 of the French insurance Code).I only got them acting that way.
